On September 8, Quebec's finance minister, Éric Girard, tabled a draft regulation setting out various categories of civil liability insurance contracts exempt from the rules set out in articles 2500 and 2503 of the Civil Code. Any interested parties (persons or companies) may share their reactions to this draft regulation and may submit comments and/or recommendations in writing.

Since it represents some 3,680 certified insurance brokers working in over 415 firms and branch offices province-wide, the RCCAQ wrote to the finance minister and shared various observations on the draft regulation, which is entitled Categories of insurance contracts and insured parties that may derogate from the rules of articles 2500 and 2503 of the Civil Code.

The RCCAQ's letter included a number of observations and potential ways forward, particularly as regards the main issue involving groups 1 and 2 identified in section 1, more specifically insurance covering the civil liability of directors and officers (D&O), in addition to the stipulation that the same minimum coverage requirement applies to small brokerage firms.

The RCCAQ asked the minister to ensure that the coverage available to businesses is adequate and affordable, in particular by paying special attention to exclusions (sometimes numerous) involving premium hikes, coverage limits and increases in deductibles.
