Legal Column > Reminder: Anti-Spam Act (Bill C-28)
Prior to taking effect in July 2017, Bill C-28 (otherwise known as Canada's Anti-Spam Act) had garnered headlines for nearly three years. Today, it is part and parcel of brokerage firms' standard practices. We are now offering a tool designed to serve as a "quick reference guide" to the legislation's basic principles.
Please note that the Anti-Spam Act is designed to limit the number of commercial emails sent out without recipients' express or tacit consent. Here are the four criteria that must be complied with whenever we would like to encourage someone to take part in a commercial activity:
To ensure that you have your clients' consent and to keep a record thereof, please feel free to use this specially designed consent form.
As an RCCAQ member, you have access to different tools such as a memorandum written in collaboration with our legal firm that is directly tailored to the needs of brokerage firms. You can also listen to this short audio interview (french only) with Mr. Jobin to gain a better understanding of your role as a broker under the anti-spam legislation.
You are also advised to read the original text of the Act on the federal government's website: http://laws-lois.justice.gc.ca/PDF/E-1.6.pdf.
If you have any further questions, please contact the RCCAQ via email (communications@rccaq.com) or phone (450-674-6258, ext. 229).
