New attempts by auto dealers to circumvent the rules

Thanks to brokers' vigilance and the RCCAQ's initiatives, in particular, light has been shed on the illegal practices engaged in by some auto dealers. Nevertheless, some dealerships continue to look for ways around the rules. Here is a new case that was reported to the RCCAQ.

Some auto dealers make their customers sign a declaration in which the clients state that they themselves completed and sent in the form for the required insurance information. We have strong reasons to doubt whether this is actually the case. It would appear that auto dealers are continuing to fill out the declaration form themselves, only to submit it to an insurance agent with a view to obtaining an application.

This practice violates the legal boundaries of the auto dealers' role. Under no circumstances are auto dealers authorized to engage in either of the following activities:

  • Gathering personal information with a view to obtaining a quote.
  • Completing an insurance quote request or an insurance application on the client's behalf or helping clients to complete one (even if requested to do so by the client).

These are questionable practices in the face of which brokers must remain vigilant!
