Changes to IBC claim forms for condo owners

Following the adoption of Bill 141, various changes have been made in the area of condominium insurance (known as "divided co-ownership" in Quebec). A number of amendments to the provincial Civil Code came into effect on December 13. They involve:

  • The description of "private portions" or areas.
  • The funds earmarked by the syndicate for payment of deductibles or if there is insufficient or no insurance.
  • The right of subrogation.
  • The syndicate's obligations if a claim is not submitted. 

To reflect these changes, the Insurance Bureau of Canada (IBC) has modified the wording of certain forms for co-owner occupants (BAC 1510Q/BAC 1511Q) made available to insurers.

The updated version of these forms will come into effect on March 15, 2019 and should be reflected in the co-ownership insurance contracts offered to your clients. To facilitate the implementation of these changes, the IBC also issued rider BAC 1599Q pertaining to changes to co-ownership insurance contracts with the same types of coverage as on the revised forms.
