The RCCAQ has reiterated the importance of reviewing the Act respecting the distribution of financial products and services (which regulates professional insurance brokers) and welcomes the provincial government's efforts in this regard.
With respect to Bill 141, we believe it important to submit a number of recommendations to ensure the adoption of legislation that is both fair and efficient in terms of consumer protection. These recommendations are set out in our most recent position paper.
Here is a summary of the RCCAQ's recommendations:
• Include a provision aimed at ensuring that clients receive proper advice by requiring the involvement a certified representative, such as an insurance broker, at some point during online transactions.
• Establish a limited certification status applicable to individuals who sell insurance products under the "exception program" enabling distribution without the involvement of certified representatives.
• If the current distribution guide is not maintained, ensure that the RCCAQ takes part in developing the new solution put in place.
• Reassign CHAD's powers to the AMF, as proposed in Bill 141.
